Elevate Legal Accounting

The Client acknowledges that trust account compliance ultimately remains the responsibility of the law firm and its principals, and Elevate Legal Accounting provides support services only.

1. Introduction

These Terms and Conditions (“Terms”) govern your use of the services provided by Elevate Legal Accounting (“we”, “us”, or “our”).

By engaging our services or using our website, you (“Client”, “you”, or “your”) agree to be bound by these Terms.

2. Services

Elevate Legal Accounting provides specialised services including:

  • Legal bookkeeping

  • Trust account management and reconciliations

  • Financial reporting and oversight

  • Compliance support for law firms

The scope of services will be defined in a separate written agreement, proposal, or engagement letter.

3. No Legal or Financial Advice

While our founder is a qualified attorney, all services provided by Elevate Legal Accounting are strictly limited to:

  • Accounting support

  • Financial administration

  • Compliance assistance

We do not provide:

  • Legal advice

  • Tax advisory services (unless expressly agreed in writing)

Clients should seek independent professional advice where required.

4. Client Responsibilities

The Client agrees to:

  • Provide accurate, complete, and timely information

  • Maintain proper internal controls over financial data

  • Review all reports and reconciliations provided

  • Notify us promptly of any discrepancies

We are not responsible for errors arising from incomplete or inaccurate information supplied by the Client.

5. Fees and Payment Terms

  • Fees will be outlined in your service agreement or pricing plan

  • Monthly retainers are billed in advance unless otherwise agreed

  • Once-off services are payable upfront or as agreed

  • Late payments may result in suspension of services

We reserve the right to adjust pricing with reasonable notice.

6. Confidentiality

We treat all client information as strictly confidential.

All financial, legal, and business information provided to us will:

  • Be used solely for the purpose of delivering services

  • Not be disclosed to third parties without consent, unless required by law

7. Data Protection

We process personal and business data in accordance with our Privacy Policy.

Where applicable, we implement safeguards aligned with international data protection standards.

8. Limitation of Liability

To the fullest extent permitted by law:

  • Elevate Legal Accounting shall not be liable for any indirect, incidental, or consequential damages

  • Our total liability shall be limited to the fees paid by the Client for the services in question

We are not responsible for:

  • Regulatory penalties resulting from client actions or omissions

  • Decisions made based on financial reports provided

9. Indemnity

The Client agrees to indemnify and hold Elevate Legal Accounting harmless against any claims, losses, or damages arising from:

  • Inaccurate or incomplete information provided by the Client

  • Misuse of financial data or reports

  • Breach of applicable laws or regulations by the Client

10. Third-Party Software and Tools

We may use third-party platforms such as QuickBooks Online, Xero, or Clio.

We are not responsible for:

  • Downtime or errors of third-party systems

  • Data loss caused by external providers

Use of such platforms is subject to their respective terms and policies.

11. Termination

Either party may terminate services:

  • In accordance with the agreed notice period

  • Immediately in cases of material breach

Upon termination:

  • All outstanding fees become payable

  • We may suspend access to services and systems

12. Intellectual Property

All materials, templates, systems, and processes developed by Elevate Legal Accounting remain our intellectual property unless otherwise agreed.

Clients may not reproduce or distribute our materials without written consent.

13. Independent Contractor Relationship

Elevate Legal Accounting operates as an independent contractor.

Nothing in these Terms shall be construed as creating:

  • A partnership

  • Employment relationship

  • Joint venture

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of South Africa, unless otherwise agreed in writing.

15. Amendments

We reserve the right to update these Terms from time to time.

Updated versions will be published on our website with the revised effective date.
